Terms of Service

1. Acceptance of Terms

By accessing or using PoolChem ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App. Continued use of the App after any updates constitutes acceptance of the revised Terms.

2. Eligibility

This App is intended for use by individuals who are at least 18 years of age. By using PoolChem, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the App.

3. Description of Service

PoolChem is a pool chemistry tracking and guidance tool designed to help residential pool owners manage water chemistry parameters, including but not limited to Free Chlorine, pH, Total Alkalinity, Calcium Hardness, CYA/Stabilizer, Salt, and Langelier Saturation Index (LSI).

The App is intended for personal, non-commercial residential use only and is not designed for commercial pool management.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.

4. Important Disclaimer — Health and Safety

By using this App, you acknowledge and agree that:

• All chemical dosing recommendations are approximate and based on standard formulas. Actual results may vary based on your specific pool conditions, water source, equipment, and other factors.
• Improper chemical handling can result in serious injury, property damage, or death.
• You are solely responsible for any chemicals you add to your pool and for how they are handled and stored.
• You must always follow manufacturer instructions, safety labels, and all applicable laws and regulations.
• You should retest your water after making any chemical adjustment before adding additional chemicals.
• You should consult a licensed pool professional for persistent issues or before making significant changes to your pool system.

Industry Standards and Guidance

PoolChem's recommendations are based in part on generally accepted industry guidelines, including standards such as ANSI/APSP/ICC-11 (2019) and subsequent updates, where applicable. However, such standards may change and may not reflect current regulations in your jurisdiction.

The App does not guarantee compliance with any applicable laws, codes, or regulations. You are solely responsible for ensuring compliance with all federal, state, and local requirements.

5. Accuracy of Information

While we strive to provide accurate formulas and guidance, all information is provided for general informational purposes only.

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose.

We do not guarantee that any recommendation will achieve a specific result or chemical balance.

6. Data Storage

All data you enter into PoolChem (including readings, settings, inventory, and notes) is stored locally on your device. We do not collect, transmit, or store your pool data on any external servers.

You are solely responsible for backing up your data using available export features. Local data may be deleted at any time due to browser settings, device changes, updates, or other factors beyond our control.

We are not responsible for any loss of data and cannot recover data stored on your device.

7. In-App Purchases

PoolChem offers optional in-app purchases ("Pro" upgrade) to unlock additional features. All in-app purchases are processed by Apple through the App Store and are subject to Apple's Terms and Conditions.

By making a purchase, you agree to the following:

• All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.
• To request a refund, you must contact Apple directly through their support channels or at reportaproblem.apple.com.
• PoolChem does not process payments or have access to your payment information.
• Purchased features are tied to your Apple ID and can be restored on any device by using the "Restore Purchase" option within the App.
• Pricing is displayed in your local currency within the App and may vary by region.
• Prices are subject to change, but changes will not affect purchases already completed.
• We reserve the right to modify, add, or remove purchasable features at any time.
• Existing purchased features will remain accessible.

8. Intellectual Property

PoolChem, including its code, design, calculations, user interface, and content, is the intellectual property of its owner and is protected by applicable laws.

You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.

You retain ownership of any data you enter into the App. All rights not expressly granted are reserved.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Use the App in a commercial or professional service setting
• Attempt to reverse engineer, decompile, or extract source code
• Interfere with or disrupt the functionality or integrity of the App
• Distribute, resell, or exploit the App without authorization
• Use the App in any way that could harm others or create liability

10. Limitation of Liability

To the maximum extent permitted by law, PoolChem and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of data, or financial loss arising from your use of or inability to use the App.

This limitation applies to all claims, including those based on negligence, to the extent permitted by law.

In all cases, total liability shall not exceed the amount you paid for the App or any in-app purchases.

Your use of the App is entirely at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless PoolChem and its owners from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of or related to:

• Your use or misuse of the App
• Your handling or use of pool chemicals
• Your violation of these Terms
• Your violation of any applicable laws or regulations

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

13. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. You are responsible for reviewing these Terms periodically.

14. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located within California.

15. Entire Agreement

These Terms constitute the entire agreement between you and PoolChem regarding use of the App and supersede any prior agreements or understandings.
